Application for extension of time to nominate certain traffic infringements if no actual notice provided.
Section 67 of the Road Safety Act 1986 (Vic) allows for an additional option to nominate outside the normal timeframes commonly associated with traffic infringements through Fines Victoria. If you have been made aware of a traffic infringement which you have received in the mail, through communications with Victoria Police or the Sheriff’s Department; and you had no previous knowledge of this infringement due to another person being the offender, you may be eligible to apply for the court to grant you an extension of time to nominate that other person.
However, to be eligible, certain conditions must be sufficed:
- Traffic infringements that have been incurred because of drink driving, drug driving or excessive speed are not covered under this section and therefore cannot use this late extension exception to nominate.
- An application to the court must be made within 14 days of becoming aware of the infringement.
