Demerit points will be recorded against your licence for most driving offences. The number of demerit points recorded for driving offences vary depending on which offence you have committed. You may find a list of demerit point offences on the VicRoads website.

When you have accumulated too many demerit points you run the risk of having your licence suspended.

VicRoads are responsible for maintaining the demerit point system and your demerit points are a separate matter to the courts and police.

How many demerit points can I have before my licence is suspended?

If you are a full licence holder then you cannot have more than 11 demerit points recorded against your licence, within 3 years. Alternatively, if you are a learner or P-plate driver then you must not have more than 4 demerit points recorded against your name, within 12 months.

What happens if I accumulate too many demerit points?

In this situation, VicRoads will send you a demerit point notice. This is a letter that provides you with 2 options. The first option is to not drive for a period of suspension. The second option is to keep your licence but refrain from incurring any more demerit points for a 12 month period.

If you fail to reply to this letter within 21 days then VicRoads will automatically suspend your licence, with the date commencing  as listed on your demerit point notice.

Between the two options, which one should I choose?

If you choose the second option and decide to keep your licence with the intention of not incurring further demerit points for a 12 month period, but then subsequently obtain another demerit point within that 12 month period, your licence will be suspended for double the amount of time than it would have been than if you had decided to wear option one.

What if I have to go to work or have to pick up my children from school?

You must not drive at all during your suspension period. There are no exceptions and you will need to organise alternate means of transport during the time your licence is suspended for.

Is there anything else I can do to prevent my licence from being suspended?

You may appeal the decision of VicRoads if you believe they have made a mistake when adding up the number of demerit points attributed to your licence or there has been a mistake in a driving offence that has been attached to you.
