Immediate driver license and/or learner permit suspensions

When charged, it is important to note that certain offences will lead to an immediate suspension by Victoria Police.
- In November 2020, new license suspension laws for excessive speeding and serious motor vehicle offences where a motor vehicle is used a weapon in the commission of the offence were introduced. Immediate suspension laws apply to:
- Any person who is caught driving 45km/h or more over the speed limit or 145km/h or more in a 110km/h.
- Any person who has been charged with murder, attempted murder,gross violence offences or causing serious injury offences if they used a motor vehicle in the commission of the offence and it resulted in death or injury.
The suspension will begin immediately and will last until:
- A suspension or cancellation that is associated with a Traffic Infringement Notice commences, or
- The charge is determined by the Court, or
- The suspension is withdrawn by the Court, or
- The suspension is revoked on appeal.
Some offences which lead to an immediate suspension are:
- Drink and/or drug-driving offences.
- Dangerous driving or excessive speeding.
- Serious motor vehicle offences where the vehicle has been used as a weapon in the commission of the offence and it resulted in death or injury.
If you are charged with such an offence, you may appeal against the decision to suspend your drivers licence and/or learner permit in the Magistrates’ Court.
